Former President Donald Trump has filed a motion in Fulton County, requesting more than $6.2 million from the Fulton County District Attorney’s Offstart to cover attorney fees and litigation costs associated with a recently dismissed criminal election interference case. A newly implemented Georgia law permits defendants to seek reimbursement for their legal expenses if a prosecutor is disqualified and the case is subsequently dismissed. Sources have indicated that the law may have been designed specifically for such scenarios.

Legal Framework and Timing

According to the legislation, defendants have a window of 45 days from the dismissal date to file their claims for “reasonable attorney’s fees and costs.” The final decision on these claims will rest with Judge Scott McAfee. Trump’s legal team and many Georgia Republicans have consistently characterized the prosecution as politically motivated.

Background of the Case

In August 2023, Fulton County District Attorney Fani Willis announced an indictment against Trump and 18 co-defendants, alleging violations of Georgia’s anti-racketeering law, linked to efforts aimed at overturning the results of the 2020 election in favor of Joe Biden. However, the situation shifted dramatically when a defense attorney disclosed a romantic relationship between Willis and Nathan Wade, the special prosecutor assigned to the case. Although they maintained that the relationship did not influence the prosecution, the Georgia Court of Appeals ultimately ruled that Willis could not continue with the case due to an “appearance of impropriety.”

In November, Peter J. Skandalakis, the Executive Director of the Prosecuting Attorneys Council of Georgia, took over as the leading prosecutor. Shortly thereafter, Skandalakis moved to abandon the case, arguing that the actions detailed in the indictment were insufficient to sustain a racketeering charge. A Fulton County Superior Court judge dismissed the case on November 26.

Legal Expenses

Trump’s legal expenditures in Georgia have been substantial. According to public filings analyzed by the Atlanta Journal-Constitution, his political action committees have reportedly spent over $5.5 million on legal representation in the state since 2021. This total includes:

  • Over $1.5 million paid to lead attorney Steve Sadow since August 2023.
  • Nearly $1.5 million to former attorney Drew Findling.
  • More than $2.2 million to attorney Jennifer Little from March 2021 to August 2024.
  • $326,000 combined for three additional Georgia attorneys.
