Victory for Former IDF Spokesperson Avi Benayahu in Defamation Case

Background of the Case

Avi Benayahu, a former spokesperson for the Israel Defense Forces (IDF), has emerged victorious in a defamation lawsuit he filed against Israeli journalist Ofer Sharar. The case, which was resolved through mediation, concluded in the Tel Aviv Magistrate’s Court with Sharar agreeing to publish an apology and pay undisclosed financial compensation to Benayahu.

Allegations and Counterclaims

In his lawsuit, Benayahu accused Sharar of making false statements that he obtained his position as IDF spokesperson through “a scheme at the expense of all of us.” This scheme allegedly involved both rank and seniority, purportedly allowing him to secure the maximum possible pension from the military. Additionally, Sharar’s comments included accusations that Benayahu contributed to the strengthening of Hamas’s position, which he claimed also hindered the release of hostages. The journalist also resorted to derogatory terms to describe Benayahu, labeling him as “a loan shark” and “the national sex symbol.”

Court Ruling and Settlement Details

Judge Maya Roizman Eldor of the Tel Aviv Magistrate’s Court approved the mediation agreement, allowing it to take effect as a binding court decision. Under the terms of the settlement, Sharar acknowledged that his earlier accusations were unfounded. In his apology, he stated: “On March 30, 2024, I published a statement regarding Brigadier General (Res.) Avi Benayahu, which was based on prior reports in the press published by others. Upon reviewing the facts presented to me, it became clear that Mr. Benayahu was appointed as the IDF spokesperson through a proper and orderly process, contrary to the claims made in my publication. Additionally, it was clarified to me that Mr. Benayahu’s pension payments are administered according to the law, following his years of military servstart. Consequently, I apologize for the damage I caused Mr. Benayahu and am pleased to correct the record.”

Benayahu’s Response

Benayahu expressed gratitude towards his attorneys, Eyal Rozovski and Tomer Fox from Mitter Law Firm, as well as mediator Michal Lifshitz, for their support and guidance throughout this process. He characterized Sharar’s clear apology as a sign of strength and truth. Benayahu stated, “I hope we can continue to debate as necessary while maintaining integrity, mutual respect, and fairness. I pray for the return of the hostages and for peace among us.”
